10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTSTEADY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims under these Terms shall not exceed the amount paid by you to PortSteady in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless PortSteady, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Termination
Either party may terminate these Terms with 30 days written notice. We may terminate or suspend your access immediately for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will cease immediately.
